These Terms of Service (“Terms”) govern your access to and use of the Freedomforge Custom Creations LLC website, online store, products, customization tools, hosted stores, quote forms, and related services.

Throughout these Terms, “Freedomforge,” “we,” “us,” and “our” refer to Freedomforge Custom Creations LLC. “Customer,” “you,” and “your” refer to the person or organization accessing the website, submitting artwork, requesting a quote, or purchasing products or services.

By accessing our website, submitting a quote request, approving a proof, or purchasing from us, you agree to these Terms and our related policies.

  1. Online Store and Shopify

Our online store is hosted and powered by Shopify. Shopify provides the ecommerce platform that allows us to offer products and services to customers.

Your use of Shopify-supported features may also be subject to Shopify’s applicable terms and privacy practices.

  1. Eligibility and Customer Accounts

You must be legally capable of entering into a binding agreement to place an order.

You are responsible for:

  • Providing complete and accurate account, billing, shipping, and contact information

  • Maintaining the confidentiality of your account credentials

  • All activity conducted through your account

  • Updating information when it changes

  • Confirming that purchases are lawful in your location

We may suspend or restrict an account when we reasonably believe it has been used fraudulently, unlawfully, or in violation of these Terms.

  1. Products and Services

Freedomforge provides custom branding, engraving, printing, apparel, headwear, drinkware, promotional products, hosted stores, fundraiser merchandise, design services, event services, and related products.

We make reasonable efforts to display product descriptions, colors, dimensions, materials, prices, and images accurately. Actual products may vary slightly because of:

  • Screen and monitor settings

  • Material grain or texture

  • Manufacturing tolerances

  • Product or blank availability

  • Engraving, printing, and finishing processes

  • Supplier changes or product substitutions approved by the customer

We may modify, discontinue, limit, or replace a product or service at any time.

  1. Quotes and Pricing

Quotes are based on the specifications, quantities, products, artwork, production method, delivery requirements, and other information available when the quote is prepared.

Unless stated otherwise, quotes are valid for 30 days.

A quote may be revised if:

  • Quantities or product selections change

  • Artwork requires additional preparation

  • Supplier pricing or availability changes

  • Shipping or delivery requirements change

  • The project scope changes

  • Information provided for the original quote was incomplete or inaccurate

Website prices, quotes, discounts, promotions, and availability may change without notice. A pricing error does not require us to fulfill an order at the incorrect price.

Applicable taxes, shipping, special handling, artwork, setup, rush, digitizing, or design charges may be added when appropriate.

  1. Order Acceptance

Submitting an order or payment does not guarantee acceptance.

We may refuse, limit, hold, or cancel an order because of:

  • Product or material availability

  • Pricing or listing errors

  • Artwork concerns

  • Suspected fraud

  • Legal or shipping restrictions

  • Production limitations

  • Customer account issues

  • An inability to complete the requested project safely or appropriately

If we cancel an order before production for reasons unrelated to customer conduct, we will refund eligible amounts paid for the canceled portion.

  1. Payments and Deposits

Payment requirements may vary by product or project.

We may require:

  • Full payment before production

  • A deposit before ordering materials or beginning design work

  • The remaining balance before pickup, shipping, delivery, or event setup

  • Separate payment for approved additions or changes

Deposits, artwork fees, setup fees, digitizing fees, rush fees, and special-order material charges may become non-refundable after the related work or purchase begins.

Late or unpaid balances may delay production, fulfillment, delivery, store payouts, or future orders.

  1. Custom Orders and Proof Approval

Custom production begins only after all required payment, artwork, information, materials, and approvals have been received.

When a proof is provided, the customer must carefully review:

  • Spelling and grammar

  • Names, dates, numbers, and personalization

  • Artwork and logo selection

  • Product colors and sizes

  • Design placement and orientation

  • Quantities and product selections

  • Any other project-specific details

Approval confirms that the customer accepts the design as shown. Freedomforge is not responsible for errors that were visible in an approved proof.

Most projects include up to two standard proof-revision rounds. Additional revisions, major redesigns, artwork recreation, or changes in project scope may require additional fees and production time.

  1. Customer Artwork and Content

By submitting artwork, logos, trademarks, photographs, text, names, or other content, you represent that:

  • You own the content or have permission to use it

  • Our use of the content to complete your order will not violate another party’s rights

  • The content is not unlawful, fraudulent, defamatory, threatening, hateful, or otherwise prohibited

  • You have authority to submit the content on behalf of the identified person, business, team, department, or organization

Freedomforge may refuse content that we reasonably believe is unlawful, infringing, unsafe, deceptive, or inappropriate for production.

You are responsible for claims arising from content you submitted without proper authorization.

  1. Artwork Preparation and Design Services

Customer artwork may require cleanup, conversion, recreation, digitizing, resizing, color adjustment, or other preparation.

Additional fees may apply when artwork is not production-ready.

Customer-owned logos and other pre-existing intellectual property remain the property of their respective owners.

Unless otherwise agreed in writing:

  • Paying for a finished product does not automatically transfer editable design files, production files, templates, source files, or manufacturing settings

  • Ownership and permitted use of original artwork created by Freedomforge will be determined by the applicable quote, invoice, or separate agreement

  • Production methods, settings, templates, workflows, and internal files remain Freedomforge property

  1. Production Times

Standard custom production is generally estimated at 10–12 business days after all required payment, artwork, information, materials, and proof approval have been received.

Bulk, wholesale, specialty, outsourced, hosted-store, fundraiser, event, and large-volume orders may require additional time.

Production dates are estimates, not guaranteed completion dates. Weekends, holidays, shipping time, supplier delays, customer-response delays, and events outside our reasonable control are not included unless specifically stated.

Rush production requires advance written approval and may include additional fees.

  1. Shipping and Local Pickup

Shipping, delivery, carrier delays, address accuracy, damaged shipments, and local pickup are governed by our Shipping Policy:

Customers are responsible for providing a complete and accurate shipping address.

Risk associated with theft or loss after confirmed delivery may remain with the customer, subject to applicable law and our Shipping Policy.

  1. Returns, Refunds, and Cancellations

Returns, refunds, cancellations, proof revisions, damaged products, and non-returnable products are governed by our Refund Policy:

Custom and made-to-order products generally cannot be returned, exchanged, or refunded after final proof approval and the start of production.

  1. Customer-Supplied Products and Materials

Customer-supplied products or materials are accepted only with prior approval and are processed at the customer’s risk.

Even when reasonable care is used, engraving, printing, pressing, cutting, handling, or testing can reveal hidden defects or damage customer-supplied items.

Unless specifically agreed in writing before production, Freedomforge does not guarantee replacement or reimbursement for customer-supplied items that are defective, incompatible, improperly prepared, or damaged during a normal production attempt.

  1. Hosted Stores, Team Stores, and Fundraisers

Hosted stores, team stores, company stores, school stores, fundraisers, collaborations, and organization merchandise may be governed by a separate written agreement.

That agreement may establish:

  • Setup and monthly fees

  • Product selection

  • Store access

  • Organization earnings

  • Profit-sharing or fundraiser amounts

  • Minimums and order periods

  • Artwork permissions

  • Fulfillment and distribution

  • Returns and exchanges

  • Store closure or suspension

When a separate written agreement conflicts with these general Terms, the specific written agreement controls for that hosted store or program.

  1. Restricted Products and Legal Compliance

Certain products may be restricted by federal, state, or local law or by carrier, marketplace, or payment-provider rules.

Customers are responsible for confirming that they are legally permitted to purchase, possess, receive, and use any restricted product in their jurisdiction.

We may:

  • Restrict shipping destinations

  • Request additional information

  • Refuse or cancel an order

  • Limit quantities

  • Require acknowledgment of applicable restrictions

Attempting to bypass a restriction, misrepresent eligibility, or provide a prohibited shipping destination may result in cancellation without fulfillment.

Nothing on our website is legal advice or a guarantee that a product is lawful in every jurisdiction.

  1. Product Use and Safety

Customers are responsible for using products appropriately and following applicable care, safety, manufacturer, and legal instructions.

Freedomforge is not responsible for damage or injury caused by misuse, improper installation, unauthorized modification, negligent handling, or use outside a product’s intended purpose.

  1. Intellectual Property

The Freedomforge name, logos, website content, product photography, original graphics, text, designs, templates, and other brand materials are owned by or licensed to Freedomforge Custom Creations LLC.

They may not be copied, reproduced, sold, distributed, modified, or used commercially without written permission.

Third-party names, logos, and trademarks remain the property of their respective owners.

  1. Project Photography and Portfolio Use

Unless confidentiality is agreed to in writing before production, Freedomforge may photograph completed products and use those photographs to demonstrate our work in our website, portfolio, social media, advertising, samples, or other marketing.

We will not intentionally publish confidential customer information.

Customers who require confidentiality must notify us in writing before production begins.

  1. Reviews and Customer Submissions

If you submit a review, testimonial, photograph, comment, or other non-confidential feedback, you grant Freedomforge permission to use, reproduce, display, and share that content for business and marketing purposes.

You confirm that your submission is truthful and does not violate another person’s rights.

  1. Third-Party Services and Links

Our website may use or link to third-party services, applications, catalogs, payment providers, shipping providers, customization tools, review platforms, and other websites.

We are not responsible for the availability, accuracy, security, content, policies, or performance of third-party services.

Use of a third-party service may be subject to that provider’s separate terms and privacy policy.

  1. Prohibited Uses

You may not use our website, products, services, or customization tools to:

  • Violate any law or regulation

  • Infringe intellectual-property or privacy rights

  • Submit false, misleading, fraudulent, or unauthorized information

  • Upload malware or harmful code

  • Interfere with website or account security

  • Scrape, copy, or exploit website content without permission

  • Harass, threaten, defame, or harm another person

  • Attempt to bypass product, account, payment, or shipping restrictions

  • Use our services for unlawful or deceptive activity

We may suspend access or cancel affected orders when these rules are violated.

  1. Disclaimer of Warranties

To the maximum extent permitted by law, the website and services are provided on an “as available” basis.

We do not guarantee that the website will always be uninterrupted, error-free, secure, or free from technical problems.

Any warranties that cannot legally be excluded remain in effect as required by applicable law.

  1. Limitation of Liability

To the maximum extent permitted by law, Freedomforge Custom Creations LLC and its owners, employees, contractors, suppliers, and service providers will not be liable for indirect, incidental, special, punitive, or consequential losses arising from use of the website, products, or services.

Where liability cannot be excluded, our total liability will not exceed the amount paid for the specific product or service giving rise to the claim, except where a different remedy is required by law.

Nothing in these Terms excludes rights or remedies that cannot legally be waived.

  1. Indemnification

You agree to defend, indemnify, and hold harmless Freedomforge Custom Creations LLC and its owners, employees, contractors, and service providers from claims, losses, liabilities, and reasonable expenses arising from:

  • Content or artwork you submit

  • Your violation of these Terms

  • Your violation of applicable law

  • Your infringement of another party’s rights

  • Your misuse of our products or services

  1. Events Outside Our Control

Freedomforge is not responsible for delays or failures caused by circumstances outside our reasonable control, including severe weather, natural disasters, fire, flood, power or equipment failure, labor disruption, supplier shortages, carrier delays, government action, public emergencies, or internet and platform outages.

We will make reasonable efforts to communicate significant delays and resume work when practical.

  1. Privacy

Our collection and use of personal information are governed by our Privacy Policy:

  1. Changes to These Terms

We may update these Terms to reflect changes in our business, services, technology, or legal obligations.

The updated version will be posted on this website with a revised effective date. Continued use of the website after an update constitutes acceptance of the revised Terms.

  1. Severability and Waiver

If any portion of these Terms is found unenforceable, the remaining provisions will remain in effect.

A failure to enforce a provision on one occasion does not waive our right to enforce it later.

  1. Governing Law

These Terms are governed by the laws of the State of Indiana, without regard to conflict-of-law principles.

Any dispute not resolved informally will be subject to the appropriate courts located in or serving Madison County, Indiana, unless applicable law requires otherwise.
